الملخص
ملخص: تُعتبر المضاربة غير المشروعة نشاطًا تجاريًا تدليسياً يهدف إلى إحداث تقلبات غير طبيعية في السوق للاستفادة من الظروف المتغيرة وتحقيق أرباح شخصية، ونظرًا لانتشار هذه الممارسة بشكل واسع، فإن النصوص القانونية المتعلقة بقواعد المنافسة والممارسات التجارية لم تتمكن من القضاء عليها، وذلك بسبب ظهور أساليب جديدة تتضمن الخداع والاحتيال والتضليل، مما يتعارض مع المبادئ الأخلاقية للأعمال التجارية، لذلك قام المشرع الجزائري بإصدار قانون خاص لمكافحة هذه الظاهرة، وهو القانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة، الذي صدر في 28 ديسمبر 2021. إن مكافحة بعض الممارسات التجارية التي تحمل طابع الاحتيال والخداع تتطلب تدخلًا جنائيًا للحد منها، وذلك لضمان أمن واستقرار الاقتصاد والمجتمع. كلمات مفتاحية: جريمة، المضاربة، غير المشروعة، مكافحة.Abstract: Unlawful speculation is a fraudulent commercial activity that aims to cause abnormal fluctuations in the market to take advantage of changing conditions and achieve personal profits. Given the widespread prevalence of this practice, legal texts relating to competition rules and commercial practices have not been able to eliminate it, due to the emergence of new methods that include deception, fraud and misleading, which conflict with the ethical principles of business. Therefore, the Algerian legislator has issued a special law to combat this phenomenon, namely Law No. 21-15 on Combating Unlawful Speculation, which was issued on December 28, 2021.
