As Machine Intelligence tools continue to evolve and exert increasing influence over public life, the need for constitutional frameworks capable of keeping pace with these developments has become ever more pressing particularly in relation to the protection of digital rights and the safeguarding of the rule of law within digital environments. While the Algerian Constitution currently lacks explicit provisions regulating the use of artificial intelligence or formally recognizing digital rights, several comparative constitutional experiences such as those of Italy, Canada, and Spain have begun to address this emerging reality. These constitutions have introduced principles such as the right to data protection, algorithmic transparency, and institutional oversight of AI applications within public administration, offering a potential roadmap for constitutional innovation in Algeria.
