This study addresses the issue of liquidating Islamic bank clients’ debts through collateralization, whereby the bank seeks to convert its deferred financial claims into immediate liquidity by pledging those debts to a third-party financier. The objective is to strike a balance between compliance with Islamic jurisprudence and legal efficiency. The research is grounded on two main hypotheses: the permissibility of pledging debts under civil law, and the potential acceptance of such practice in Islamic jurisprudence, provided it avoids usury (riba) and excessive uncertainty (gharar). Employing a comparative analytical methodology that deconstructs concepts, analyzes legal and juristic texts, and balances Islamic jurisprudence with modern law, the study favors the Maliki position which allows pledging a debt to someone other than the debtor, based on the financial value of the debt and the feasibility of constructive possession. The research proposes an applied framework that reconciles legal and Shariah requirements. It fills a gap in contemporary literature on liquidity management mechanisms within Islamic banks, while maintaining fidelity to Islamic jurisprudential foundations. It further advocates for the development of legislative frameworks specific to Islamic finance that align with its ethical and operational distinctiveness and support its sustainable growth.
