الملخص
ملخــــــص: قد تعد مسألة التدخل التشريعي الأخير بموجب القانون رقم: 24-06 المعدل والمتمم لقانون العقوبات الجزائري، المنصب على إضافة مصطلح "الاغتيال" وجعله يتصل ببعض الجنايات المؤدية الى إزهاق روح الإنسان التي كانت تسمى سابقا بالقتل العمد؛ على أنها مجرد نظرة حديثة للمشرع. بينما في الحقيقة يعد ذلك بمثابة التصحيح للأوضاع من أجل إقامة التطابق بين النصين باللغتين العربية والفرنسية من القانون ذاته. وهو ما لم يوفق فيه المشرع الى حد ما، من خلال إدخاله في مفهوم الاغتيال ما يعد خارجا عن مدلول الغيلة كأساس شرعي وقانوني لهذه التسمية، وهو ما أـردنا تسليط الضوء عليه أولا والتوصية لما يصوب الوضع ثانيا. Abstract: The recent legislative intervention through Law No: 24-06, which amends and supplements the Algerian Penal Code by introducing the term "assassination" and associating it with certain crimes leading to homicide—previously referred to a murder—may be seen as a modern perspective adopted by the legislator. However, in reality, this move represents an attempt to correct the situation by aligning the Arabic and French versions of the same law. Yet, the legislator was only partially successful, having included in the definition of assassination acts that fall outside the scope of ambush, which is a fundamental legal and legitimate basis for this term. This study aims first to shed light on this issue and, secondly, to recommend ways to rectify the situation.
