Contractual Conditions For Petroleum Contracts: The Condition Of Stability And Non-infringement As A Model

Authors : Terbah Terbah .

Abstract

This study explores the implications of stabilization and non-alteration clauses in international contracts, particularly those between oil-producing states and foreign investors. These clauses offer legal security and stability, encouraging foreign investment by preventing unilateral changes to the contract. However, they also limit the host state's ability to amend its laws, raising concerns about sovereignty and legal flexibility. Through qualitative legal analysis, the study examines the validity and enforcement of these clauses, highlighting their impact on investor confidence and state sovereignty. Key findings suggest that while these clauses enhance legal certainty, they can lead to conflicts with national laws and international obligations. The study concludes that a balanced approach is needed to address these challenges and ensure a stable investment environment
