التكافؤ الوظيفي في الترجمة القانونية Functional Equivalence In Legal Translation

الملخص
تعتبر الترجمة القانونية من بين ميادين الترجمة المتخصّصة الأكثر صعوبة وتعقيدا إذا ما قورنت بغيرها من الأنواع الأخرى؛ ومردّ ذلك أنّ الرسالة القانونية لا يتم نقلها من لغة إلى أخرى فحسب، وإنّما تتّم من نظام قانوني إلى نظام آخر فضلا عن نقلها للعوامل الثقافية، ويعّد التكافؤ من القضايا الأساسية التي لها قيمة في مجال الدراسات المقارنة والدراسات الترجمية، والذي يعتبر أحد الاستراتيجيات الهامة في الترجمة التي بإمكانها أن تذلّل صعوبة نقل الرسالة القانونية عبر اللّغات والنظم القانونية. وبما أن للتكافؤ أنواع عديدة، يركّز هذا المقال على التكافؤ الوظيفي سعيّا إلى إستكشاف مدى ملاءمته في ترجمة النصوص القانونية وتذليل صعوبات نقل الرسالة القانونية التي تتّم عبر نظامين قانونيين مختلفين Abstract: In comparison with the other types of Translation, Legal translation is a challenging and complex process. This is due to the fact that the legal message is not only transferred from one language to another, but also from one legal system to another, in addition to the transfer of cultural elements, equivalence is one of the basic issues that plays a major role in both fields Comparative Studies and Translation Studies, which is considered one of the most important strategies in translation whereby we can overcome the difficulty of conveying the legal message across languages and legal systems. Since there are many types of equivalence, this article sheds light on functional equivalence in an attempt to explore its suitability in translating legal texts and overcoming the difficulties of conveying the legal message that takes place through two different legal systems.
