ملخص: تعد إشكالات التنفيذ الجزائية أو النزاعات العارضة ذات طبيعة قضائية حيث اعتبرها المشرع الجزائري بأنها إجراءات من اختصاص القضاء وحده وهذا ما أكدته المادة 14 في فقرتها الأولى من قانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين التي تضمنت بأنه ترفع النزاعات العارضة المتعلقة بتنفيذ الأحكام الجزائية بموجب طلب أمام الجهة القضائية التي أصدرت الحكم أو القرار، من خلال نص المادة يتبين بأنها دعوى جزائية من اختصاص القضاء وهي ضمان للمحكوم عليه يلجأ للقضاء للفصل فيها وحدد رفع إجراءاتها ويصدر بشأنها حكم قضائي، ولا بد من توافر شرط الصفة والمصلحة في رافع دعوى النزاع العارض، ومن خلال الموضوع حاولنا تسليط الضوء على مفهوم النزاعات العارضة في تنفيذ الأحكام الجزائية والدعوى المتعلقة بها وشروط رفعها أمام الجهات المختصة. الكلمات المفتاحية: النزاعات العارضة، تنفيذ، دعوى النزاع العارض. Abstract: Conflicting issues in penal enforcement or disputes are of a judicial nature, as considered by Algerian legislation, which deems them procedures under the jurisdiction of the judiciary alone. This was affirmed by Article 14, paragraph 1, of the Law on the Organization of Prisons and the Social Reintegration of Detainees, which stipulates that conflicting disputes related to the enforcement of penal judgments can be raised by a request before the judicial authority that issued the judgment or decision. Through the text of the article, it becomes evident that it is a penal lawsuit within the jurisdiction of the judiciary, ensuring the rights of the convicted who resort to the judiciary for resolution, where its procedures are initiated, and a judicial ruling is issued regarding it. The condition of standing and interest must be met by the plaintiff in raising the conflicting dispute, and through this topic, we attempted to shed light on the concept of conflicting issues in the enforcement of penal judgments and related lawsuits and the conditions for raising them before the competent authorities.
