New In Constitutional Oversight Through Exception Of Unconstitutionality

Abstract

The plea of unconstitutionality is considered one of the strongest mechanisms in the field of constitutional oversight for the protection of rights and freedoms. Recently, the legislator has endowed it with a set of formal, substantive, and procedural regulations, which we aim to present in this research as a practical guide for interested parties. This is particularly relevant due to the recent amendments and the significance and strength of the plea, as it may lead to the annulment or amendment of certain laws. We conclude the study by assessing this mechanism and providing a set of recommendations to improve its performance.
