دور القضاء في تكييف العقوبة السالبة للحرية

الملخص
تماشيا مع السياسـة العقابية الحديثـة وتحقيقا لأغراض الإصـلاح والتأهيـل وإعادة الإدمـاج الاجتماعي للمحبوسيـن، خول المشـرع الجزائري لقاضـي تطبـيـق العقوبـات واللجان المساعدة له مهمة التدخل المباشر في مرحلة تنـفيذ العقوبـة، وتكييفها بما يتلاءم وحالة كل محكوم عليه على حدة. فصلاحيات قاضـي تطبيـق العقوبـات في تكييف العقوبـة السالبــة للحريــة، تجسد مبدأ استمرارية تدخـل القضاء بعد انتهاء مسار الدعوى العمومية، مما يعني تدعيم أساليب المعامـلـة العقابيـة، وإخضاع المحبوسيـن لأنظمة بديلة للعقوبة بعد الحكم بها، تقوم على مبدأ المكافأة وحسن السلوك، ورد النص على أغلبها في القانون 05/04 ،المتعلق بتنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين، وأضاف القانون 18/.01 ما استحدث منها، حيث يشرف عليها القاضي بنفسه، مما يجعله ضمانة أكيدة لحماية الحقوق والحريات داخل المؤسسـة العقابيـة. In line with the modern penal policy , and for the purpose of the reform, rehabilitation , and the social reintegration of the imprisoned persons ; the Algerian legislator empowered the sentence enforcement judge and his assistance committee the direct intervention to implement the sanction , and adapt it to suit each sentenced separately. The powers of the sentence enforcement judge to adapt the custodial penalty, embody the principle of the continuity judicial intervention after completing the course of the public prosecution; which means strengthen the punishment treatment methods, and subject the imprisoned persons to the systems based on the principle of reward and the good conduct. The text has accepted the most of them in the law 04/05, and what has been introduced from; was added by the law 01/18, Where they are supervised by the judge himself, which make him a firm guarantee to protect the rights and freedoms within the penal institutions.
