الملخص
إن أهمية موضوع مستجدات التقاضي في محاكم الدرجة الأولى للقضاء الإداري تكمن في توضيح مستجد هذا التقاضي وتهدف إلى كشف الغموض الذي يواجه الباحثين والمختصين في هذا المجال من خلال تفصيل الفروقات التي تميز كل واحد منهما من حيث الكادر البشري والمعيار العضوي الذي يحدد طبيعة النزاعات الإدارية والاختصاص النوعي والإقليمي لكل منهما، والشروط الشكلية والموضوعية للتقاضي أمامهما، وكيفيات ممارسة الطعون العادية أمامهما، كما أن هذا الموضوع يعتبر من مواضيع الساعة المهمة جدا في القانون الإداري والذي كرس من خلاله المشرع الجزائري مبدأ التقاضي على درجتين تجسيدا للإصلاحات التي جاء بها المؤسس الدستوري من خلال دستور 2020، ولهذا تم تقسيم هذا البحث إلى جزئين، فالجزء الأول تناولنا فيه المحاكم الإدارية كدرجة أولى للتقاضي من حيث سيرها وإجراءات التقاضي المستحدثة أمامها، وفي الجزء الثاني تناولنا المحكمة الإدارية للاستئناف بالجزائر العاصمة كدرجة أولى للتقاضي من حيث سيرها وإجراءات التقاضي المستحدثة أمامها. Abstract: The importance of the topic of litigation developments in the courts of First Instance of administrative judiciary lies in clarifying the newness of this litigation and aims to uncover the mystery facing researchers and specialists in this field by detailing the differences that distinguish each of them in terms of human staff and the organic criterion that determines the nature of administrative disputes, specific and regional jurisdiction. Also, this is considered one of the very important topics in administrative law, through which the Algerian legislator has enshrined the double-hearing principle, embodying the reforms brought by the constitutional founder through the Constitution of 2020،, and that is why this research was divided into two parts, the first part of which dealt with the administrative courts as the first instance of litigation in terms of its conduct and the litigation procedures developed before it, and in the second part we dealt with the Administrative Court of Appeal in Algiers as the first instance of litigation in terms of its conduct and the litigation procedures before it.
