الملخص
ملخص: منازعات إنتخابات المجالس الشعبية المحلية هي منازعات إدارية خاصة تتكون من المنازعات التالية: منازعات الشطب والإغفال عن التسجيل، منازعات رفض أعضاء مكاتب التصويت، منازعات رفض الترشح، منازعات الإعلان المؤقت للنتائج. والمشرع الجزائري قد خصها بالعديد من الإستثناءات التي تظهر من خلال خروجه عن المعيار العضوي في واحدة منها، وفي آجال رفعها والفصل فيها، وفي عدم وضوح شرط المصلحة والصفة، وفي الأحكام والقرارات التي تفصل فيها،...الخ، وهو ما دفعنا الى البحث عن مدى مساسها بممارسات التقاضي المضمونة بموجب دستور2020، والقانون رقم: 08-09 المعدل والمتمم بموجب القانون رقم22-13 المتضمن قانون الإجراءات المدنية والإدارية في ظل الخصوصيات التي تميزها. Abstract: Disputes of elections to local people's councils are special administrative disputes that contain the following disputes: disputes of write-off and omission from registration, disputes of members of voting bureaus' rejection, disputes of refusal to run, disputes of provisional announcement of results. The Algerian Legislature has singled out many exceptions that appear through its departure from the organic standard in one of them, in the deadlines for filing and adjudication, in the lack of clarity of the requirement of interest and status, and in the provisions and decisions that adjudicate them...This prompted us to research the extent to which it affects the litigation practices guaranteed by the Constitution of 2020, and Law No. 08-09; amended and supplemented by Law No. 22-13 containing the code of civil and Administrative Procedure in light of the particularities that distinguish it.
