تأثير استخدام النظام الإلكتروني للصفقات العمومية على فعالية الإجراءات

الملخص
في الواقع تُعد الصفقات العمومية الركيزة الأساسية لأي عملية تنموية، حيث تمثل وسيلة لتوزيع الموارد العامة بهدف تحقيق الأهداف التنموية الشاملة. ومع التقدم التكنولوجي الذي يشهده العالم وظهور الحلول الرقمية، تواجه السلطات الجزائرية تحديًا يتجاوز مجرد التحول نحو الرقمنة في إجراءاتها، ليشمل تحقيق الكفاءة الاقتصادية والاجتماعية لها. ويزداد هذا التحدي أهمية مع صدور القانون 23-12 الذي ينظم القواعد العامة للصفقات العمومية، مما يستدعي البحث عن إجراءات تُعزز الشفافية والنزاهة في النشاط الاقتصادي، مع تقليل الهدر في المال العام ومكافحة الفساد بشكل فعّال. : Abstract In fact, public transactions constitute a fundamental pillar in the framework of any developmental process, functioning as a legal mechanism for the distribution of public resources with the aim of achieving overarching developmental goals. In light of the global technological advancements and the integration of digital solutions, Algerian authorities are confronted with a challenge that extends beyond the mere digitization of public transactions procedures. This challenge entails ensuring the economic and social efficiency of transactions, operations while also adhering to the principles of the Law 23-12, which codifies the general legal framework governing public transactions. This further underscores the need to search measures that reinforce transparency and integrity within the economic activity, thereby minimizing the mismanagement and misuse of public funds, and effectively address corruption.
