Abstract: Manuscripts are considered among the most significant cultural and historical artifacts produced by civilizations and cultures throughout history, due to their pivotal role in preserving knowledge, tracking intellectual development, and documenting it. Additionally, they are a crucial source for research and investigation, and they represent the finest embodiment of Arab-Islamic heritage. Therefore, the nations possessing them have sought to employ every possible means to preserve them, with digitization being one of the most important strategies. However, despite being regarded as one of the key methods to ensure the longevity and sustainability of manuscripts, digitization has raised several questions regarding the creative effort involved in achieving it on one hand, and the protection of the rights of their original owners on the other. This paper seeks to address these issues by examining whether the process of transferring a manuscript from its traditional form to a digital one constitutes a creative work deserving of protection under copyright law. The study concludes that the digital manuscript should be regarded as a creative work in the context of copyright law, as it involves intellectual contribution, while also extending protection to its original components. The study further suggests allocating a percentage of the revenues generated from its exploitation to the owners of the original manuscripts, akin to the tracking right.
