التوجه نحو التنفيذ الالكتروني للاحكام القضائية الادارية في الجزائر

الملخص
ملخص: مما لا شك فيه أن التقاضي الإداري الإلكتروني جاء لتحقيق هدف وهو الوصول إلى العدالة الناجزة التي تتجسد في سرعة إصدار الأحكام القضائية الإدارية، وتكون تلك الجهود معدومة القيمة إذا لم يتمكن المحكوم له من تنفيذ حكمه خاصة إذا امتنعت الإدارة عن التنفيذ بحجة تمتعها بامتيازات السلطة العامة، وتأسيسا على ذلك وضع المشرع الجزائري جملة من الآليات القانونية لإلزام الإدارة بضرورة تنفيذ الأحكام أو القرارات الحائزة لقوة الشيء المقضي فيه، وفي سبيل تسريع عملية استيفاء الأفراد حقوقهم من قبل الإدارة يستلزم الأمر استعمال الوسائل الإلكترونية في مرحلة التنفيذ متى كان ممكنا وبالشكل القانوني الصحيح، وهو ما سيشكل بضرورة نقلة نوعية نحو خلق نظام المحكمة الإدارية الإلكترونية القائمة على الرقمنة والعدالة. Abstract: There is no doubt that electronic administrative litigation came to achieve a goal, which is to achieve prompt justice, which is embodied in the speed of issuing administrative judicial rulings. These efforts are worthless if the judgment recipient is unable to implement his ruling, especially if the administrative refrains from implementing it under the pretext of enjoying the privileges of public authority .Based on this, the Algerian legislator has established a set of legal mechanisms to oblige the administration to implement rulings or decisions that have the force of res judicata . In order to accelerate the process of individuals receiving their rights from the administration, it is necessary to use electronic means in the implementation phase whenever possible and in the correct legal form, which will necessarily constitute a qualitative shift towards creating an electronic administrative court system based on digitization and justice.
