المحكمة الدستورية والسلطة القضائية في الجزائر

الملخص
تمارس المحكمة الدستورية دورا هاما في ضمان استقرار المؤسسات الدستورية داخل الدولة ، اذ تربطها علاقة تعاون و رقابة مع السلطات العامة داخل الدولة ،لاسيما منها السلطتين التشريعية والتنفيذية عن طريق اشرافها على عملية تنصيبهما مع اخضاع اعمال كل منهما لرقابتي الدستورية والمطابقة الممارسة من قبل المحكمة الدستورية ، مع التزمها بالفصل في الخلافات التي تنشأ بيتهما ، غير أن علاقتها بالسلطة القضائية تمتاز بنوع من الخصوصية على اعتبار أن المحكمة الدستورية تبسط رقابتها على كافة النصوص القانونية المنظمة للسلطة القضائية، سواء تعلق الأمر بهيكلة الجهاز القضائي أو بالاختصاصات الممنوحة لها ، و النصوص الخاصة بالنظام الخاص بالقضاة ، مع التزام القاض بتطبيق القرارات الصادرة عن المحكمة الدستورية ، كما تجمعهما علاقة تعاون و تكامل انطلاقا من أن الجهات القضائية تعتبر بمثابة وسيط بين الافراد و المحكمة الدستورية اعمالا لألية الدفع بعدم الدستورية حفاظا للحقوق و الحريات الأساسية للمواطن، انطلاقا من أن اثارة الدفع بعدم الدستورية يثار أمام الجهات القضائية ، و يخضع للتصفية الثنائية قبل احالتها للمحكمة الدستورية .
