الهجرة غير الشرعية والملاحة الدولية في الجزائر تحديات وآفاق

الملخص
تشهد الملاحة الدولية كأحد شرايين بلوغ التنمية في عصرنا هذا الكثير من التحولات التي أفرزت ظواهر سلبية في شاكلة الهجرة الغير شرعية، هذه الأخيرة التي تتم عبر الاجتياز الغير المشروع للحدود البحرية وبغض النظر عن الدوافع والمبررات الكامنة من وراءها؛ فهي تعد تهديدا للأمن البحري وسلامة الملاحة الدولية، مما أدى إلى تشكل قيودا خطيرة على الحركة العادية بها، بفعل ما صاحبها من تشكل بيئة ملائمة لنمو الجماعات المنظمة المرتكبة لجرائم منظمة. وتبعا لانعكاسات الهجرة الغير شرعية الوخيمة على الملاحة الدولية في مختلف مجالات الأمن- اقتصاديا؛ اجتماعيا؛ صحيا، تحركت المجموعة الدولية تحت مظلة الأمم المتحدة لمواجهة التحديات المستجدة مع استجابة الحكومات لحتمية تنصيب مخرجاتها في القوانين الوطنية، والجزائر أسوة بذلك وبالنظر لما يحصل في شريطها الساحلي من نمو لظاهرة الغير الشرعية، سعت إلى تنظيم وضبط المعضلة؛ فعمد المشرع البحري والمشرع العقابي إلى جانب نصوص قانونية متشعبة إلى التنصيص القانوني الوقائي والزاجر معا في سبيل كبح الظاهرة وتخفيف من وطأتها.
