الحقوق المالية للدائنين بالنفقة بين إلتزام الدولة و إجراءات التقاضي

الملخص
الملخص: لقد ألزم المشرع الجزائري رب الأسرة بالإنفاق على الزوجة و الأبناء بموجب قواعد قانونية آمرة من قانون الأسرة، وعلى ذلك الأساس نص المشرع بموجب قانون العقوبات على معاقبة المتهرب من هذه الإلتزامات المالية أو المهمل لها، باعتبارها دين عليه من وقت توثيق رابطة الزواج، و لا تسقط هذه الأخيرة حتى في حال فك هذه الرابطة بالطلاق، إذ حق المطلقات و الأطفال المحضونين يظل قائما. ولكن الواقع المعاش أثبت تعاسة نسبة من المطلقات و الأطفال المحضونين بصفتهم دائنين لرب الأسرة المدين الذي لم يسدد نفقة أسرته كليا أو جزئيا أو توقف عن دفع هذه الأخيرة عمدا أو لعجز أصابه أو لظروف خاصة ألمت به. و إنطلاقا من منطق الدولة الإجتماعية عالج المشرع هذه الإشكالية بتأمين إستمرارية دفع نفقة العائلات المطلقة تحت إشراف القضاء مهما كان سبب عدم الدفع، دون إهمال المتابعة الجزائية للمدين. Abstract:The Algerian legislator has obliged the husband to provide for the needs of his wife and children in accordance with the mandatory legal rules of family law.. On this basis, the legislator provides, within the framework of the Penal Code, the punishment of those who evade these financial obligations or neglect them.It is considered a debt on his part from the moment the matrimonial bond is established, and this is not lost even if this bond is dissolved by divorce, because it is a right that remains into effect. However, the current reality has demonstrated the discontent of a certain percentage of divorced families due to the fact that the ex-husband does not pay the alimony of his family, in whole or in part, or that he deliberately stops paying this debt, or even because of his incapacity.Based on the logic of the social state, the legislator addressed this problem by ensuring the continuity of the payment of alimony for divorced families under the control of the judiciary, regardless of the reason for non-payment, without neglecting the criminal prosecution of the debtor.
