Bridging The Gaps: Deconstructing The Legal Nature Of Presidential Ordinances In The Algerian And Egyptian Context

Authors : Ferouani Amal Linda . Amr Ali Ahmad .

Abstract

Art 142 of the Algerian Constitution and Art 156 of the Egyptian Constitution authorize the President of the Republic to issue ordinances within legally prescribed areas under specified conditions. This authority extends to diverse domains, including financial matters and exceptional circumstances, necessitating an examination of the legal nature of such ordinances. The classification of ordinances—whether as administrative or legislative acts—affects the form and extent of judicial oversight applicable to them. This study aims to analyze the legal nature of presidential ordinances in Algeria and Egypt, calling for clearer constitutional definitions to address ambiguities in their legal status, and recommending reforms for enhanced oversight and clarity..
