.Abstract: The general principle requires the application of laws to everything that occurs within the territory of the state and to all persons present therein, regardless of nationality. This is based on the idea of the state’s sovereignty over its territory, which is regarded as one of its foundational pillars. Criminal prosecution is one of the means by which the state maintains security and protects its interests, as well as those of individuals within its territory. However, this principle is subject to exceptions due to the immunity enjoyed by certain individuals, which prevents them from being subject to the legal or judicial jurisdiction of the state in which they are present. Conversely, the legislator has established a specific mechanism that enables the judiciary to prosecute certain individuals for acts unrelated to the performance of their official duties, which pertains to the lifting or waiver of immunity. Key words: Criminal law territoriality, substantive immunity, procedural immunity, immunity lifting, criminal prosecution.
