مهام السلطة المينائية بين ضمان الخدمة العامة ، وتحرير ممارسة الانشطة التجارية

الملخص
الملخص: ظل قطاع الموانئ منذ الاستقلال الى غاية 1998، تاريخ تعديل الامر 76-80 المتضمن القانون البحري الجزائري ، محتكرا من طرف الدولة وبصدور القانون 98-05 ، اصبح بالإمكان تحرير قطاع الموانئ من سيطرة الدولة ولو تدريجيا ، بدءا باستحداث سلطات مينائية ، تعمل على ادارة الموانئ وتسييرها . تهدف هاته الورقة البحثية ،الى تسليط الضوء على مهام السلطة المينائية بعد تعديل القانون البحري سنة 1998 ، وصدور المراسيم المنظمة للسلطات المينائية وتحديد اختصاصاتها ، والذي تبنى الفصل بين مهام الخدمة العمومية ، والتي اسندت الى السلطات المينائية ، وفتح الانشطة التجارية امام الخواص ، مع احتفاظ السلطة المينائية بممارسة بعض الانشطة التجارية ، والتوفيق بينهما ، بالرغم من صعوبة الامر من الناحية العملية نظرا لعدة اعتبارات . وعلى الرغم من مرور اكثر من عقدين على صدور النصوص التشريعية ، الهادفة الى تطوير عمل الموانئ لمواكبة التطورات الدولية خاصة في المجال الاقتصادي ، إلا انه والى غاية كتابة هاته الأسطر لازالت السلطات المينائية لم تنصب ، ومهام تسيير الموانئ مسندة الى المؤسسات المينائية ، بالرغم من تصريحات وزراء النقل المتعاقبة حول الاسراع في انشائها . ا Abstract: The port sector has long been monopolized by the Algerian state, from independence until the issuance of Law 98/05, modifying and completing the 76-80 ordonnance related to Algerian maritime law .it became possible to liberate the port sector from state monopoly, throught the creation of port authorities which will be in charge managing Algerian ports This research paper aims to shed light on The competencies of port authorities following the 1998 amendment to the Maritime Code and the issuance of decrees regulating port authorities and defining their powers. by this amendment the legislator adopted the separation of public service duties, which were assigned to port authorities, and commercial activities which can be realized by private sector, while the port authority retained some commercial activities. Reconciling these two aspects is difficult, despite the practical difficulty of this matter due to several considerations. Despite the fact that the legislative texts, aiming to develop the task of ports to keep pace with international developments, especially in the economic field, until the time belling, port authorities have not yet been appointed, and the tasks of managing ports are assigned to port institutions, even through statements of successive Transport Ministers that his establishment is imminent.
