قراءة في أهمّ مستجدّات قانون الإجراءات الجزائيّة وقانون العقوبات الفرنسيّين بالقانون رقم 2023-22

الملخص
في إطار عصرنة المادّة الجزائية وتبسيط الإجراءات الجزائيّة، سنّ المشرع الفرنسي القانون رقم 2023-22، المؤرخ في 25 جانفي 2023 والمتعلق بتوجيه وبرمجة وزارة الداخلية، والمعروف ب LOPMI والصادر في 25 جانفي 2023. يهدف هذا القانون إلى زيادة الموارد البشريّة لوزارة الدّاخلية وتحديث أساليبها، لاسيما من خلال جعل الرّقمنة محور اهتماماتها. أدخل القانون تعديلات جوهريّة على كل من قانون الإجراءات الجزائيّة وقانون العقوبات الفرنسيّين. فيما يخصّ الإجراءات الجنائية، تمّ اتّخاذ العديد من التّدابير في سبيل تحديث آليات مكافحة الجرائم السّيبرانية، تعزيز مرحلة التّحقيق وتحسين استقبال الضّحيّة. قانون العقوبات بدوره تمّت مراجعته، حيث وسّع القانون رقم 2023-22 من ترسانة الجرائم، لا سيما من خلال تجريم إدارة المنصّات الخبيثة عبر الأنترنت من قبيل الواب المظلم، تشديد العقاب في جريمة استغلال حالة جهل أو وضعية ضعف عن طريق الاحتيال، الخ. As part of the modernization in criminal matters and the simplification of criminal procedure, the French legislator promulgated Law No. 2023-22 of January 24, 2023, on the orientation and programming of the Ministry of the Interior, known as LOPMI, published on January 25, 2023. The objective of this law is to increase the human resources of the Ministry of the Interior and to modernize its methods, in particular by placing digitalization at the center of its concerns. LOPMI made substantial changes to criminal procedure and the French penal code. Concerning the criminal procedure, numerous measures have been taken to modernize the means of combating cybercrime, strengthen the investigation process and improve the reception of the victim. The penal code has been revised, Law No. 2023-22 has expanded the arsenal of offenses: in particular by criminalizing the administration of malicious platforms such as the dark web, fraudulent abuse of a state of ignorance or a situation of weakness is severely punished, etc.
