Abstract

This study aims to examine the limits of the investigative judge’s authority in light of the amendments introduced by Law No. 25-14 amending the Algerian Code of Criminal Procedure, while highlighting the newly established mechanisms for managing seized assets in criminal proceedings. The first part of the study analyzes the powers granted to the investigative judge during judicial investigation, including the authority to initiate investigative procedures, hear the accused, victims, and witnesses, and issue various judicial orders such as arrest, summons, detention, and judicial supervision. It also examines the investigative measures available to the judge, including searches, seizures, on-site inspections, and the appointment of experts. The study further addresses the legal limitations imposed on these powers in order to ensure a balance between the effectiveness of criminal investigations and the protection of fundamental rights and freedoms. These safeguards include the supervision of the Indictment Chamber, respect for the rights of defense, and compliance with procedural legality. In its second part, the research discusses the concept of criminal seizure of assets and its objectives, particularly in preserving evidence, preventing the disposal of illicit assets, and enabling their confiscation. It also highlights the new mechanisms introduced by Law No. 25-14 for managing seized property, such as establishing specialized bodies responsible for asset management, allowing the sale of certain assets before the final judgment when necessary, depositing seized funds in dedicated bank accounts, and exploiting some seized properties to preserve their economic value. The study concludes that these reforms reflect the orientation of Algerian criminal policy toward strengthening the effectiveness of criminal justice, particularly in combating corruption, economic crime, and money laundering, while ensuring the protection of individual rights and procedural guaranties
