الملخص
الملخص: إن حماية الحقوق المعنوية والمالية للمؤلف من خلال الأمر 03/05 المتعلق بحقوق المؤلف تعتبر إعترافا من المشرع على جهده وإبداعه الأدبي أو الفني المنقح بثمار العقل وحقوق المعرفة وتقديرا لدوره البناء في إثراء معالم المعرفة وأسس التحصيل العلمي والثقافي، إلا التسليم بأن هاته الحقوق الممنوحة للمؤلف والتي تمكنه من الإستئثار باستغلال مصنفه وحقه في منع الغير مصنفه دون إذنه هي حقوق مطلقة من شأنه أن يصطدم بحق الجمهور في الإفادة من هذا الصرح العلمي والمعرفي لاستعماله لأغراض البحث والتدريب والتعليم والترفيه وغيرها، مما جعل المشرع يعتمد جملة من القيود والحدود القانونية على الحقوق المعنوية والمالية للمؤلف بالقدر الذي يضمن الحق المشروع لهذا الأخير وحق المجتمع الذي ينتسب إليه. Abstract : The protection of intellectual and financial rights of authors through the law 03/05 related to copyright is an acknowledgment by the legislator of their literary or artistic effort, refined by the fruits of the mind, and their rights to knowledge. It also recognizes their constructive role in enriching the landmarks of knowledge and the foundations of scientific and cultural achievement. However, it is acknowledged that these rights granted to the author, which enable them to exploit their work and prevent others from using it without permission, are absolute rights that may clash with the public’s right to benefit from this scientific and intellectual edifice for purposes such as research, training, education, entertainment, and more. Consequently, lawmakers have imposed a set of legal restrictions and boundaries on the moral and financial rights of authors, striking a balance that ensures both the legitimate rights of authors and the rights of the community to which they belong.
