أفعال وتقريرات الإمام مالك بن أنس في غير العبادات - دراسة فقهية مقارنة - العقوبات أنموذجا

الملخص
ملخص: منزلة الأئمة المجتهدين وعلى رأسهم إمام دار الهجرة مالك بن أنس، كبيرة وعظيمة في قلوب المسلمين على مر الأزمان فهو إمام دار الهجرة، وفقيه الأمّة، وأحد الأئمَّة الأربعة المتَّبعين في بلادِ الإسلام، ضربت له أكباد الإبل وجاءه الطلبة من كل حدب وصوب فنقلوا عنه كل شيء، ومما نقلوه عنه أفعاله وتقريراته، فهل هي في الاحتجاج والدلالة مثل قوله؟ وهل تخرج على أنها مذهبه؟ وهل يصح الاقتداء بها وتقليده فيها؟ وقد كانت الدراسة لهذا البحث دراسة فقهية مقارنة أصولية في مبحثين منصبة على أبواب الفقه في غير العبادات، أولها دراسة فعل الإمام مالك وغيره من المجتهدين من حيث حجيتها وحكم التقليد والاقتداء بأفعال الأئمة من حيث الجواز والمنع، مع تعداد أفعال الإمام مالك وتقريراته في غير العبادت، وثانيها دراسة فقهية لتقرير الامام مالك في باب العقوبات. وقد خلص البحث إلى أن أفعال الإمام لا تقلد ولا يقتدى بها إلا بشروط وضوابط، مع بيان الفرق بين أفعال النبي ﷺ وأفعال الأئمة المجتهدين، وأن إقراره في باب العقوبات موافق لمقاصد الشرع ومراميه. Abstract: The status of the diligent imams, and at their head, the imam of the house of migration, Malik bin Anas, is great in the hearts of Muslims, as he is one of the four imams followed in the countries of Islam. The students came to him from all sides, and they narrated everything from him, and from what they transmitted from him was his actions and his acknowledgment. Does he understand that it is his doctrine? Is it correct to follow it and imitate it? The study for this research was a comparative jurisprudential study in two sections focused on the chapters of jurisprudence other than worship, the first of which is a verb study Imam Malik and other mujtahids in terms of their authenticity and the rule of imitation and following the actions of the imams in terms of permissibility and prohibition, with an enumeration of actions Imam Malik and his reports in matters other than worship, and the second is a jurisprudential study of Imam Malik’s report in the chapter on penalties The research concluded that the actions of the imam are not imitated except with conditions and controls, with an explanation of the difference between the actions of the Prophet, may God bless him and grant him peace, and the actions of the diligent imams.
