الملخص
في ظل الثورة الرقمية التي يشهدها العالم، أصبحت البيوع الإلكترونية تمثل أحد أشكال التجارة ومظهرًا من مظاهر الاقتصاد الحديث الذي فرض نفسه في عصر التكنولوجيا الرقمية. حيث تبرز قضايا الغش كنازلة من أبرز النوازل في البيوع الإلكترونية، مما يتطلب دراسة فقهية دقيقة لبيان أسبابها وضوابطها. يتعين أن تتماشى هذه المعاملات مع المبادئ الشرعية لتقليل آثارها من جهة، ولحماية المستهلك من هذه الممارسات من جهة أخرى. Abstract: In light of the digital revolution that the world is witnessing, electronic sales have emerged as a significant form of trade and a key aspect of the modern economy in the age of digital technology. Issues of fraud have surfaced as one of the most prominent challenges in electronic sales, necessitating a rigorous jurisprudential study to clarify their causes and regulatory measures. It is essential that these transactions align with the principles of Islamic law to mitigate their negative impacts and, concurrently, to safeguard consumers from such practices. This research aims to explore the jurisprudential implications of electronic sales, providing a comprehensive framework for understanding and addressing these challenges within an Islamic legal context.
