جريمة نشر الصورة الشخصية على مواقع التواصل الاجتماعي دراسة مقارنة (دراسة مقارنة)

الملخص
من خلال هذه الدراسة سنتطرق الى تسليط الضوء على احدى الجرائم الالكترونية التي اصبحت اكثر انتشار على الفضاء المعلوماتي، وهي جريمة نشر الصور الشخصية للأفراد على مواقع التواصل الاجتماعي من دون اذن صاحبها، التي اضحت تشكل اعتداء على الحياة الخاصة الشخص والتي من شأنها احراج المعني او ان تمس بسمعته وتزعزع كيانه واستقراره النفسي، كما انها تعتبر تتسبب في اهانته وفتك لعرضه وشرفه ومخالفة للقيم الاسرية في المجتمع سواء ان كان نشرها بطرق مباشرة او غير مباشرة، كما ان جريمة النشر على مواقع التواصل الاجتماعي تتنوع بين الاساءة والتشهير والابتزاز وغيرها من الافعال الدافعة لارتكابها والتي تؤدي بشكل سلبي على حياة الاشخاص ضحايا هاته الجرائم تختلف قوانين التي تجرم هده الافعال من بلد لأخر الا انه يعاقب على جرائم النشر على مواقع التواصل الاجتماعي متى كانت تمس بسرية الحياة الخاصة للفرد، والتي تشمل السجن والغرامات المالية وحتى تعويض الضحية Thoughout this study, we will shed light onto one of the Cybercrimes that has become further widespread across the cyberspace. It is the crime of publishing personal photographs of individuals on the various social medias platforms without their owners permission. Which is considered an attack on the private life of the concerned individual, leadine to sharme of the person and affecting his reputation as well as disturbing his entirebeing and psychological wellbeing, it is also the cause of a person’s humiliation and his honor’s destruction; it is a direct violation society’s family values whether the publication of these photos was done directly or indirectly.The crime of publishing on social medias platforms can varies between abuse. Defamation. Extortion and blackmail and other acts that serves as the motives to commit these crimes. Which has a negative influence on the lives of its victims Laws criminalizing these acts differ from one country to another, but the crimes of publishing anything that can affect the confidentiality of an individual’s private life without their explicit permission can be punishable by impriosonment,financial fines, and even compensation to the victim.
