الملخص : في هذه الورقة البحثية سوف نتناول مقصد حفظ النسل، وهو من المقاصد الضرورية والكليات الخمسة التي جاءت الشرائع والملل لحفظه ورعايته وترقيته، وسارت على نهجها القوانين الوضعية المتعلقة بالصحة على تفاوت بينها في ذلك، والهدف من هذه الدراسة هو بيان مفهوم النسل ووسائل حفظه في الشريعة الإسلامية، وكذا معرفة مدى مراعاة المشرع الجزائري لهذا المقصد المشترك بين الشريعة والطب والاهتمام به من خلال نصوص قانون الصحة، ومظاهر ذلك الحفظ، ومدى المساهمة في تنشئة جيل سليم معافى من الأمراض والتشوهات والإعاقات، واتبعنا المنهج الوصفي والتحليلي والاستقرائي للنصوص الشرعية والنصوص القانونية الواردة في قانون الصحة بالبحث والدراسة والتي لها صلة وثيقة بحفظ النسل، أين توصلنا إلى أن المشرع الجزائري راعى مقصد حفظ النسل من جانب الوجود ومن جانب العدم من خلال جملة من المسائل والأحكام التي جاءت في ثنايا نصوص قانون الصحة، وقد وُفِّقَ إلى حد كبير من الناحية التشريعية والتنظيمية في حفظ هذا المقصد ورعايته. الكلمات المفتاحية : مقاصد الشريعة؛ حفظ النسل؛ قانون الصحة . Abstract: This paper will discuss one of the purposes of sharia, which is the preservation of offspring, which is one of the necessary purposes and from the five universals, which the laws and religions came to preserve, nurture, and promote, and the positive laws related to health followed in their approach, although they differed between them. The concept of offspring and the means of preserving it in sharia will be explained, through a number of provisions and means that have been legislated for this, due to the importance of this purpose and its connection to the survival of the human species and the continuation of its path on earth, and to demonstrate the extent to which the Algerian legislator takes into account this purpose, we tracked and extrapolated the medical issues contained in the health law by research and study, which are closely related to offspring Preservin, in order to determine the extent to which the Algerian legislator agrees with sharia in preserving this necessary purpose. Raising a healthy generation free from diseases, deformities and disabilities, because healthy upbringing is the basis of happiness in both worlds, the basis of all development and promotion, and the pillar of human cultures and civilizations. We have concluded that the Algerian legislator has been largely successful, from a legislative and regulatory standpoint, in preserving this purpose.
