Abuse Of Corporate Assets: Between Judicial Contribution And Adaptation To Business Life

Abstract
The offense of misuse of corporate assets aims to punish the directors of certain commercial companies who, in bad faith, have used the assets of the latter in a manner contrary to the corporate interest and for personal ends or to promote another company or business in which they have direct or indirect interests. In order to adapt to business life, justice has established, with its judgments, the explanatory parameters of the text of the law, taking into account the ambiguous nature of this offense on the one hand and its inclusion among the crimes of hidden objects whose evidence is difficult to access.
