تأثير الاعتبارات السياسية على المحكمة الجنائية الدولية

الملخص
لقد تناولت في هذا المقال دراسة احد اهم الاشكالات التي اعترضت ومازالت تعترض المحكمة الجناءية الدولية في اداء عملها، الا وهو تاثير الاعتبارات السياسية عليها، والذي كان له الاثر البالغ في التقليل من فاعلية الدور الذي تؤديه المحكمة في ضمان حماية حقوق الانسان وفي التطبيق السليم للعدالة الجناءية الدولية، ويظهر تاثير الاعتبارات السياسية من خلال غلبة الطابع السياسي على بعض نصوص النظام الاساسي للمحكمة الجناءية الدولية، والموقف المعارض للولايات المتحدة الامريكية لوجود المحكمة والتاثير على مهامها. This article examines one of the most important issues which has hindred and continue to hinder the mandate of the international Criminal Court ; that is the interférence of political consideration in the work of the ICC; a situation which diminishes the effeciency of the Court un assuring the protection of humain rights and a valid application of international criminal justice. It is worth noting that the impact of political consideration apperas un the political aspect of some of the Rome statue provisions, the opposing attitude of the United States to the Court and its will to thwart its missions. Cet article a pour objet l'etude d'une des plus importantes problématique qui continue d'entraver le bon fonctionnement de la Cour pénal internationale ; en l'occurrence l'influence des confédération politique sur son mandat; ce qui minimise la portée de son efficacité dans la protection des droit fondamentaux de l'homme, et également dans la bonne application de la justice pénal internationale. L'impact des considération politique apparaît clairement à travers certains disposition du Statut de la Cour pénal internationale, l'attitude hostile des États Unis à l'égard de la Cour et la volonté de faire échouer ses missions.
