This article advances a comprehensive and critically informed analysis of the enforcement architecture of International Humanitarian Law (IHL), also known as the law of armed conflict (jus in bello). It draws a conceptual distinction between “implementation” in its broad regulatory sense and “enforcement” as a narrower, accountability-centered framework activated in response to violations. In this latter sense, enforcement encompasses both individual criminal responsibility for war crimes and the international responsibility of States, including obligations of cessation, reparation, Enforcement of International Humanitarian Law.
