الملخص
نسعى من خلال هذه الدراسة إلى تسليط الضوء على القواعد التي تحكم تشغيل الأجانب في الجزائر، لعل أهمها نظام الرخصة، التي تضبط وضعية الأجانب ونشاطهم في الإقليم الجزائري، ومدى ملاءمتها ومبادئ القانون الدولي، وتماشيا مع سياسات الدولة بما في ذلك حق العمل تحت أطر متنوعة، وفي ظل حرية مقيدة. ومن خلال ما تم التطرق له توصلنا إلى نتيجة أساسية مفادها محدودية المنظومة التشريعية المقررة لهذا المجال باعتبارها لا تتماشى مع الأوضاع الراهنة ما يجعل من الدولة غير متحكمة في تشغيل العمال الأجانب في ظل بقاء بعض الأحكام القانونية حبيسة النصوص ولم تطبق على أرض الواقع. Abstract: Thru this study, we aim to shed light on the rules governing the employment of foreigners in Algeria, the most important of which is the licensing system that regulates the status and activities of foreigners in Algerian territory, and its compatibility with international law principles, in line with state policies, including the right to work under various frameworks, albeit under restricted freedom. Thru what has been addressed, we reached a fundamental conclusion that the legislative system governing this field is limited, as it does not align with current conditions, making the state unable to control the employment of foreign workers, especially since some legal provisions remain confined to texts and have not been implemented in reality.
