تأثير اختصاصات رئيس الجمهورية على استقلالية السلطة القضائية في التعديل الدستوري لعام 2020

الملخص
يكتسي هذا الموضوع أهمية كبيرة كونه يرتبط بمبادئ دولة القانون، تتمحور اشكاليته حول مدى تأثير اختصاصات رئيس الجمهورية على استقلالية السلطة القضائية، إذ يتمتع رئيس الجمهورية بمجموعة من الاختصاصات منها تعيين القضاة، رئاسة المجلس الأعلى للقضاء، وحق إصدار العفو. رغم دستوريتها إلاا أن ممارستها دون قيد قد يمس باستقلالية السلطة القضائية. لذا نقترح وضع بعض القيود عل ممارسة هذه الاختصاصات. Abstract: The topic holds great importance as it is linked to the principles of rule of law. It’s central issue revolves to which the President of the Republic’s exercise of his powers affects the independence of the judiciary, the president enjoys the set of powers including appointing judges, the presidency of the Supreme Judicial, and the right to pardon. Although it is constitutional, its exercise without restriction may undermine the independence of the judicial authority, there for we propose imposing certain limitations on the exercise of these powers. .
