Abstract: This article examines Walter Benjamin's 1921 essay “Critique of Violence” as a radical interrogation of the foundations of legal legitimacy. Rather than asking whether a given use of violence is justified by reference to legal ends, Benjamin displaces the question toward the very relation between violence (Gewalt) and law (Recht), distinguishing between law-making violence (rechtsetzende Gewalt), which founds a legal order through an original act of force, and law-preserving violence (rechtserhaltende Gewalt), which sustains that order once founded. Reading Benjamin alongside Carl Schmitt's theory of sovereignty, Jacques Derrida's deconstruction of the "mystical foundation of authority," and Giorgio Agamben's analysis of the state of exception, the article argues that legal legitimacy is structurally unable to purify itself of the violence that inaugurates and maintains it. It further explores Benjamin's distinction between mythic violence, which is bound to the reproduction of law and guilt, and divine violence, which suspends law in the name of a justice that exceeds it. The article concludes by assessing the contemporary relevance of Benjamin's critique for philosophy of law, arguing that it does not offer a political program but a permanent demand that legal orders be held accountable to a justice that they can never fully contain. .Keywords: Walter Benjamin, Critique of Violence, Violence as the Foundation of Law, Violence as the Preserver of Law, Legal Legitimacy, Justice, Divine Violence, State of Exception.
