بين القانون والعرف: إشكالية العدالة في الرواية العربية

الملخص
يتطرق هذا البحث الى دراسة العلاقة الملتبسة بين القانون بوصفه نظامًا معياريًا مدوّنًا، وبين العرف بوصفه سلطة اجتماعية موروثة من خلال النظر في كيفية تمثّل هذه العلاقة في الرواية العربية الحديثة، وينطلق البحث من فرضية مجراها أنّ الشرعية القانونية والشرعية الاجتماعية لا تتطابقان بالضرورة، بل كثيرًا ما تتصارعان، الأمر الذي يجعل من مفهوم العدالة موضع تجاذب دائم بين النص القانوني والقيم الجماعية، وباستثمار المرجعية الفكرية العربية في التنظير للدولة والسلطة، والمرجعية الغربية في حقل "القانون والأدب"، يحلّل المقال نماذج روائية عربية مختارة لبيان كيف تعيد الرواية صياغة سؤال العدالة خارج ثنائية القانون/العرف الجامدة، وكيف تتحوّل إلى فضاء نقدي يكشف عن حدود كلا النظامين في حماية الفرد وإنصاف المهمّشين، وتقترح تأويلًا سرديًا للعدالة يتجاوز منطق التقنين والعرف معًا. This article examines the tension between law (qanun) and custom (urf) as competing sources of legitimacy and justice, and investigates how the modern Arabic novel represents this tension. Starting from the observation that positive law and inherited social custom often produce divergent, even contradictory, conceptions of what is just, the article argues that the Arabic novel constitutes a privileged space for interrogating the limits of both normative orders. Drawing on Ibn Khaldun's theory of asabiyya, al-Arawi's account of the modern state, and al-Jabiri's critique of Arab political reason, alongside Martha Nussbaum's notion of "poetic justice" and Richard Posner's law-and-literature framework, the study analyzes selected works by Najib Mahfuz, Abd al-Rahman Munif, and al-Tayyib Salih. It shows that the novel does not merely illustrate the conflict between law and custom but actively reconfigures the meaning of justice by lending narrative voice to those excluded from both orders. The article concludes that the Arabic novel functions as a critical tribunal exposing the shared limitations of legal codification and customary authority, and calls for a hermeneutics of justice attentive to narrative as a mode of ethical and political knowledge.
