Digital Evidence In The International Criminal Court

Abstract
This study aims to highlight the importance of digital evidence in international criminal proceedings before the International Criminal Court. It examines the concept of digital evidence and the mechanisms for its collection within the International Criminal Court. The study further assesses the reliability of digital evidence based on the criteria of relevance and probative value. In addition, it addresses the main challenges associated with the use of digital evidence, including issues of authenticity and chain of custody, algorithmic bias, deepfakes, and privacy concerns. The study concludes that digital evidence has become a fundamental component of the international criminal justice system; however, its effectiveness remains dependent on the development and proper implementation of robust legal and technical frameworks.
