The development of new offenses that harm the environment, triggered by the use of pesticides during the Vietnam War, paved the way for the emergence of the concept of ecocide, considered by its serious and massive nature as an international crime. This notion, which appeared in the scientific world, has been transposed into the legal field, through proposals for codification in the Statute of the International Criminal Court, but several obstacles hinder this quest as we will discuss in this article. It appears necessary to establish a definition of ecocide and to define which jurisdiction would ensure effective prosecution.
Ecocide; Rome Statute ; Environmental Damage ; International Law Commission ; Monsanto Court.
