The Legal Protection Of Water Resources Against Pollution

Abstract
This article explores the legal protection of water resources against pollution under administrative law. It focuses on the complementary roles of the regulatory function (through administrative police) and the public service function (through water and sanitation services). The regulatory role includes preventive controls like permits and environmental assessments, as well as post-activity oversight such as inspections and sanctions. Meanwhile, the public service role ensures access to clean water and safe wastewater management. The article argues that both mechanisms are essential and interdependent. Strengthening this synergy improves pollution prevention and promotes sustainable resource management. يتناول هذا المقال موضوع الحماية القانونية للموارد المائية من التلوث في ظل القانون الإداري، مبرزًا أهمية التكامل بين الدور الضبطي والدور المرفقي الذي تمارسه السلطات العمومية. يعتمد الدور الضبطي على آليات الرقابة الإدارية، سواء الرقابة القبلية كالتراخيص ودراسات الأثر البيئي، أو الرقابة البعدية كالمعاينة والعقوبات، بهدف الحد من الأنشطة الملوثة للمياه و في المقابل، يضطلع مرفقا المياه والتطهير بدور محوري في الوقاية من التلوث من خلال ضمان توفير مياه نظيفة والتخلص الآمن من المياه المستعملة. يشكل هذان الدوران – الضبطي والمرفقي – ركيزتين أساسيتين في منظومة الحماية البيئية. ويخلص المقال إلى أن فعالية هذه الحماية لا تتحقق إلا من خلال تنسيق وتكامل الجهود بين الجانبين، بما يضمن استجابة قانونية وإدارية شاملة لمخاطر التلوث..
