The integration of artificial intelligence into administrative action challenges the traditional framework of administrative liability based on the distinction between fault-based and no-fault liability. The opacity, relative autonomy and complexity of algorithmic systems complicate the establishment of causation and accountability. In response, several legal systems advocate strengthening transparency, traceability and human oversight to ensure effective protection of citizens, while others, particularly the United States, favour a more innovation-oriented approach. This study argues that artificial intelligence requires not a radical transformation, but a gradual adaptation of administrative liability to reconcile innovation with legal certainty.
