Digital Transformation As A Mechanism For Entrenching The Principle Of Transparency In Public Administration An Analysis From The Perspective Of Administrative Law

Abstract
The accelerating pace of digital transformation has introduced profound changes in the way public administration operates, interacts with citizens, and delivers public services. Transparency, a cornerstone principle of democratic governance and the rule of law, has been significantly influenced by these technological developments. This article examines the role of digital transformation as a mechanism for entrenching the principle of transparency in public administration from an administrative law perspective. The analysis demonstrates that digi-tal technologies—including e-government platforms, open data portals, and electronic auditing systems—have fundamentally reshaped the relationship between the state and its citizens by making government operations more visible, traceable, and accountable. The article identi-fies the key mechanisms through which digital transformation enhances transparency, such as proactive information disclosure, the digitalization of public services, traceability systems, and whistleblowing platforms. Additionally, it examines the legal challenges that accompany the digitalization of public services, including data protection, algorithmic accountability, and the digital divide. The analysis concludes that while digital transformation represents a powerful tool for promoting transparency, its effectiveness depends on robust legal frameworks, institu-tional commitment, and inclusive digital policies. أدى التسارع في وتيرة التحول الرقمي إلى إحداث تغييرات جذرية في طريقة عمل الإدارة العامة، وتفاعلها مع المواطنين، وتقديمها للخدمات العامة. وقد تأثرت الشفافية، باعتبارها ركيزة أساسية للحكم الديمقراطي وسيادة القانون، تأثراً بالغاً بهذه التطورات التكنولوجية. تتناول هذه المقالة دور التحول الرقمي بوصفه آلية لترسيخ مبدأ الشفافية في الإدارة العامة من منظور القانون الإداري. يُظهر التحليل أن التقنيات الرقمية — ومنها منصات الحكومة الإلكترونية، وبوابات البيانات المفتوحة، وأنظمة التدقيق الإلكتروني — قد أعادت تشكيل العلاقة بين الدولة ومواطنيها جذرياً، من خلال جعل العمليات الحكومية أكثر وضوحاً وإمكانية للتتبع وخضوعاً للمحاسبة. وتُحدد المقالة الآليات الرئيسية التي يعزز من خلالها التحول الرقمي الشفافية، مثل الإفصاح الاستباقي عن المعلومات، ورقمنة الخدمات العامة، وأنظمة التتبع، ومنصات الإبلاغ عن المخالفات. كما تستعرض المقالة التحديات القانونية التي ترافق رقمنة الخدمات العامة، بما في ذلك حماية البيانات، والمساءلة الخوارزمية، والفجوة الرقمية. ويخلص التحليل إلى أنه، على الرغم من كون التحول الرقمي يمثل أداة قوية لتعزيز الشفافية، فإن فعاليته تتوقف على وجود أطر قانونية متينة، والتزام مؤسسي، وسياسات رقمية شاملة.
