Between Market Freedom And The Criminalization Of Speculation: A Study On The Criminal Liability Of The Natural Person Under Law No. 21-15

Abstract
Abstract: Various commercial activities are practiced by individuals within society under a regulated economic system characterized by trade freedom and the breaking of monopoly constraints. Economic transactions play a vital role in building a safe and stable community and stimulating economic development. However, certain actions by natural persons in these commercial activities have recently increased. We have seen a significant rise in prices in Algerian society without acceptable justifications, leading to distress for the Algerian citizen and hindering access to goods. This has affected their ability to meet basic needs. Simultaneously, there is a scarcity of essential goods, often monopolized by traders. This situation necessitates an urgent update of the legal framework addressing unlawful speculation, as outlined in Law No. 21-15 concerning the fight against unlawful speculation, issued in 2021. ملخص: تتعدد الأنشطة التجارية التي يمارسها الأفراد داخل المجتمع في ظل نظام اقتصادي محكم يخضع لنظام السوق الذي يتميز بالحرية التجارية وكسر قيود الاحتكار، حيث تلعب المعاملات الاقتصادية دور حيوي في بناء هذا المجتمع وتطوير هذا النظام من حيث جعله آمن ومستقر، أكثر من ذلك انعاش السوق وتحفيز التنمية الاقتصادية، غير أن هناك بعض التصرفات يقوم بها الأشخاص الطبيعية في ممارسة هاته الأنشطة التجارية التي تزايدت مؤخرا كما شهدنا في المجتمع الجزائري زيادة كبيرة في الأسعار دون مبررات مقبولة، مما أدى بالمواطن الجزائري إلى الهلاك وحد وصوله إلى السلع، حيث تمت إعاقة وتثبيط قدرته على تلبية احتياجاته الأساسية، في الوقت نفسه يمارس البعض الحالة العكسية إن كانت هناك ندرة في السلع الأساسية التي غالبا ما تكون محتكرة من قبل التجار، بحيث تستدعي هذه الوضعية تحديثا عاجلا وفوري للإطار القانوني الذي يحكم ويعالج المضاربة غير المشروعة، كما هو موضح في القانون رقم 21-15 المتعلق بمكافحة المضاربة غير المشروعة الذي تم إصداره في عام 2021.
