موقع القيم الأخلاقية من المنظومة المقاصدية عند الإمام الشاطبي

الملخص
ملخص: تسعى هذه المقال إلى بيان موقف الإمام الشاطبي من مكانة القيم الأخلاقية ضمن المنظومة المقاصدية، وذلك من خلال الكشف عن موقع القيم الأخلاقية من المنظومة المقاصدية عند الشاطبي، حيث توصلنا ومن خلال تحليل اجتهادات الإمام الشاطبي إلى أن القيم الأخلاقية لا تُعتبر مجرد تحسينيات في بناء المقاصد الشرعية؛ بل هي عنصر جوهري في تحقق المقاصد على جميع رتبها (الضرورية، الحاجية والتحسينية )، فالشريعة كلها إنما تخلق بمكارم الأخلاق، فالبُعد الأخلاقي متداخل في مقاصد الشريعة على المستويات الثلاث: الضرورية، والحاجية، والتحسينية، من خلال تجليها في الكليات الخمس، مما يدل على أهمية الأخلاق في المنظومة المقاصدية، لذا فإن فهم موقع القيم الأخلاقية ضمن المنهج المقاصدي يُعتبر مفتاحًا لفهم الشريعة في مجملها، ويبرز الحاجة إلى استحضار البُعد الأخلاقي في كل اجتهاد شرعي أو تنفيذ عملي لأحكام الشريعة. Abstract : This paper seeks to clarify Imam Al-Shatibi’s position on the role of moral values within the framework of Maqasid (objectives of Islamic law). It aims to identify the place of ethical values in Al-Shatibi’s Maqasidic system. Through analyzing Al-Shatibi’s reasoning, we find that moral values are not merely considered part of the tahsiniyyat (embellishments or complementary needs) in the structure of Maqasid. Rather, they are a fundamental component for realizing the objectives of Sharia at all levels — daruriyyat (essentials), hajiyyat (needs), and tahsiniyyat (enhancements). Indeed, the entire Sharia is based on noble moral values. The ethical dimension is interwoven into the objectives of Sharia across all three levels, as reflected in the five essentials necessities (al-kulliyat al-khams), which highlights the significance of ethics in the Maqasidic framework. Therefore, understanding the role of moral values within the Maqasidic methodology is key to understanding the Sharia as a whole and underscores the need to consider the ethical dimension in all forms of ijtihad (independent legal reasoning) or practical application of Sharia rulings.
