The Jurisdiction Of The Constitutional Court In The Field Of A Priori Review -the Case Of Legislative Ordinances-

Authors : Abdellaoui Zineb .

Abstract

Abstract: One of the innovations introduced by the 2020 constitutional amendment is the mandatory prior review by the Constitutional Court of legislative ordinances issued by the President of the Republic in urgent matters during Parliament’s recess and after obtaining the opinion of the Council of State. The Constitutional Court renders a decision in this regard that has absolute res judicata effect. The President of the Republic then submits the ordinances he has issued to both chambers of Parliament at the beginning of the following session in order to confer legal force upon them through approval. Ordinances not approved by Parliament are deemed null and void. Exceptionally, however, where circumstances change and such ordinances affect one of the rights or freedoms of individuals, they may be subject to a plea of unconstitutionality before the Constitutional Court.
