القضاء في بلاد زواوة خلال العهد العثماني

الملخص
يكتسي القضاء أهمية بالغة لدى مختلف الدول والجماعات؛ وذلك لما له من دور في حماية الحقوق ونشر الأمن والاستقرار والمحافظة على الأنفس و الأموال، وقد كانت الجزائر على مر تاريخها من بين الدول التي حرصت على إرساء العدالة بين سكانها في مختلف أماكن تواجدهم سواء كانوا في المدن أو الأرياف، ولاسيما في الفترة العثمانية حيث عملت السلطات على إرساء دعائم جهاز قضائي يراعي خصوصيات السكان بمختلف فئاتهم فأوجدت قضاء خاص بسكان المدن بمختلف أطيافهم وقضاء خاص بسكان الأرياف والمناطق الجبلية والتي أدى بعدها عن السلطة المركزية إلى وجود نظام قضائي خاص بها ،ومن بين التجمعات السكانية الجزائرية التي كانت لها ثقافة قانونية مميزة ، نجد قبائل زواوة التي تميزت بنظام قانوني خاص،عمل على سد الفراغ الناتج عن غياب السلطة المركزية بها، يجمع بين الشريعة الإسلامية والأعراف المحليةوكان سببا أساسيا في انتشار العدل فيها لفترة طويلة من خلال ما حمله من أسس ومبادئ تراعي مصلحة الفرد وتعمل على خلق مجتمع تسوده العدالة والمساواة. The judiciary is extremely important for various countries and groups; This is because it has a role in protecting rights, spreading security and stability and preserving souls and money, and Algeria has been in its history among the countries that were keen to establish justice among its residents in various places of their presence, whether they were in cities or countryside, especially in the Ottoman period, where the authorities worked to establish the pillars of a judicial body that takes in to account the peculiarities of the population in their various groups, so they found a special judiciary in the population of cities in various spectrums The countryside and mountainous regions, which then led to the central authority to the existence of its own judicial system, and among the Algerian population communities that had a distinctive legal culture, wefind the Zawawa tribes that were characterized by a special legal system, worked to bridge the void resulting from the absence of the central authority in it, combining Islamic law and local norms and was an essential reason for the spread of justice for a long time through the foundations and principles that it takes in to account the interest of the individual and work On creating a society that prevails in justice and equality.
