توظيف الذكاء الاصطناعي لإنتاج بحث قانوني مستدام: الضوابط المعيارية والتحديات

الملخص
تسلط هذه الدراسة الضوء على الانعكاسات المترتبة عن إدماج تقنيات الذكاء الاصطناعي في مجال البحث القانوني المستدام. وتهدف إلى تحليل التقاطع بين الأنظمة الخوارزمية الذكية والمنهجية القانونية، مع إبراز التحديات الجوهرية التي تثيرها هذه التقنيات، لا سيما ما يتعلق بمسائل المسؤولية، حماية الخصوصية، والتحيز الخوارزمي. وللإجابة على إشكالية القيمة المضافة التي يحققها توظيف هذه التقنيات، اعتمدت الدراسة على مقاربة تحليلية لبيان مدى قدرة الذكاء الاصطناعي على الارتقاء بجودة المعرفة القانونية وضمان استدامتها. وتخلص الدراسة إلى أن تحقيق الاستدامة البحثية يقتضي تأطيراً تشريعياً وأخلاقياً صارماً يوازن بين الابتكار التكنولوجي والمبادئ القانونية الراسخة. This study highlights the implications of integrating artificial intelligence (AI) technologies into the field of sustainable legal research. It aims to analyze the intersection between intelligent algorithmic systems and legal methodology, while underscoring the fundamental challenges posed by these technologies, particularly concerning liability, privacy protection, and algorithmic bias. To address the central research question regarding the added value of employing such systems, the study adopts an analytical approach to demonstrate AI's capacity to elevate the quality of legal knowledge and ensure its sustainability. The study concludes that achieving research sustainability necessitates a rigorous legislative and ethical framework that balances technological innovation with established legal principles. Cette étude met en évidence les implications de l’intégration des technologies d’intelligence artificielle (IA) dans la recherche juridique durable. Cette recherche vise à analyser l’intersection entre les systèmes algorithmiques intelligents et la méthodologie juridique, en soulignant les défis fondamentaux posés par ces technologies, notamment en ce qui concerne la responsabilité, la protection de la vie privée et le biais algorithmique. Pour répondre à la question de recherche centrale concernant la valeur ajoutée de l’utilisation de tels systèmes, l’étude adopte une approche analytique pour démontrer la capacité de l’intelligence artificielle à améliorer la qualité des connaissances juridiques et à assurer sa durabilité. L’étude a conclu que la durabilité de la recherche nécessite un cadre législatif et éthique strict qui équilibre l’innovation technologique avec les principes juridiques établis.
