Abstract: International commercial contracts are a fundamental method for transporting goods, merchandise, and services from one country to another, driven by mutual needs. The transfer of these assets, such as goods, merchandise, and services, from the seller's country to the buyer's country is often facilitated by maritime transport, using ships and vessels, due to lower costs and faster delivery. The passage through which these goods are transported may be the Strait of Hormuz. When a contract was concluded between a foreign exporter and a domestic importer of foreign goods, the Iranian military did not close the strait. Instead, it was closed when ships and vessels reached the strait, or after the goods had been loaded onto the ships without the importers' knowledge. Consequently, this closure disrupts the balance of contractual obligations, leading to non-performance of the contract on time, delays, or increased costs for both the exporter and the carrier. This can result in disputes between the contracting parties, and a problem of legal interpretation may arise before a judge when the parties request a ruling on the dispute. This breach of contract due to the closure of the Strait of Hormuz necessitates renegotiation of the contract's terms and content by the parties, with the application of [the relevant legal principles/conditions]. Applicable law, whether national, international, or commercial. Keywords: 1- Exceptional circumstances 2- Dispute 3- Application of law 4- Distinctive performance 5- Application of custom.
