This study addresses the issue of algorithmic persecution in artificial intelligence systems by establishing its legal nature and identifying its impact on digital human rights, particularly in light of the growing reliance on algorithms in content moderation, steering user behavior, and controlling access to information. The study primarily aims to establish the conceptual and legal foundations of the dimensions of algorithmic persecution and analyze its implications for the digital human rights framework, particularly the right to online equality, freedom of expression, non-discrimination, and the right to digital self-determination. The study concludes that this persecution poses a grave threat to digital human rights, as it leads to the reproduction of bias, reinforces digital exclusion, restricts freedom of expression, and deepens disparities among users. The study also reveals the inadequacy of current legal frameworks in addressing this emerging phenomenon, which poses a protection challenge requiring a re-evaluation of traditional legal concepts to ensure algorithmic justice in the virtual environment.
