Authors : Bertal Abdelkader .

Abstract

ABSTRACT: This study examines the mechanisms for activating ex-post constitutional review in Algeria, focusing on the 'Plea of Unconstitutionality' as a fundamental right guaranteed to litigants under the 2020 Constitutional Amendment and Organic Law No. 22-19. The paper aims to elucidate the formal and substantive conditions mandated by the legislator for the admissibility of such pleas, while analyzing the 'filtering role' exercised by the Supreme Court and the Council of State in streamlining constitutional referrals. Furthermore, the study addresses the procedural specificities before the Constitutional Court and the guarantees of a fair trial, ultimately characterizing the legal nature of procedural time-limits and their impact on the stability of legal positions.
