تطبيقات الخبرة القضائية امام القضاء المدني - المنازعات العقارية نموذجا-

الملخص
ملخص : تعتبر الخبرة القضائية من اهم وسائل التحقيق القضائي، حيث تلجا المحكمة الى الاستعانة بخبراء بهدف الإحاطة بوقائع النزاع ولاسيما الجوانب التقنية حتى يسهل على القاضي اصدار حكمه وفقا لقناعة قائمة على دليل علمي ومنطقي، لذلك تستعين المحكمة في العديد من النزاعات القضائية بخبراء مختصين لتزويدها بمعطيات تقنية لا يمكن للقاضي ادراكها دون الرجوع الى شخص مختص، وفي هذا الصدد نصت المادة 125 من قانون الإجراءات المدنية والإدارية " تهدف الخبرة الى توضيح واقعة مادية تقنية او علمية محضة للقاضي" من خلال هذه الدراسة تم التطرق الى مفهوم الخبرة القضائية من خلال تعريفها وذكر خصائصها وأنواع الخبرات التي يلجأ اليها القاضي في المواد المدنية باعتبار القضاء المدني هو المجال الخصب للاستخدامات المتنوعة للخبرة القضائية ولاسيما في مجال المنازعات العقارية، حيث تم التطرق الى مختلف المهام التي يكلف بها الخبير من سماع أطراف النزاع الى التنقل والمعاينة المادية وما يرتبط بها من مهام تقنية يلخصها الخبير في شكل تقرير يتضمن معطيات تقنية يطلبها القاضي باعتبارها مسائل مفصلية لفض النزاع. Judicial expertise is considered one of the most important means of judicial investigation. The court resorts to experts to gain a comprehensive understanding of the facts of the dispute, particularly the technical aspects, so that the judge can issue a ruling based on sound scientific and logical evidence. Therefore, in many legal disputes, the court relies on specialized experts to provide it with technical data that the judge cannot grasp without consulting a specialist. In this regard, Article 125 of the Code of Civil and Administrative Procedure states: "Expert expertise aims to clarify a purely technical or scientific fact for the judge". This study addresses the concept of judicial expertise by defining it, outlining its characteristics, and discussing the types of expertise that judges resort to in civil matters. Civil courts are considered a fertile ground for the diverse applications of judicial expertise, especially in real estate disputes. The study examines the various tasks assigned to the expert, from hearing the parties to the dispute to conducting site visits and physical inspections, and the associated technical tasks. The expert summarizes these tasks in a report containing technical data requested by the judge as crucial to resolving the dispute
