الملخص
الملخص: تبرز هذه الورقة البحثية التّـأثير العميق للتطورات العلمية الحديثة على مفهوم الشخصية القانونية، لا سيما مع بروز الكيانات الذكية الافتراضية مثل الروبوتات فائقة الذكاء. فهذه التطورات لم تعد مجرد تقدم تقني، بل أصبحت تمس مباشرة الأسس القانونية التقليدية، حيث تطرح تساؤلات حول مدى إمكانية منح هذه الكيانات حقوقًا وواجبات مشابهة للشخصيات القانونية التقليدية. ومن هنا، يبرز أهمية توسيع نطاق الاعتراف القانوني للشخصية القانونية ليشمل هذه الكيانات، مع وضع الضّمانات اللازمة لحماية المجتمع من أي تأثيرات سلبية محتملة قد تنجم عن عملها أو قراراتها، بما يضمن توازنًا بين التقدم التكنولوجي والمبادئ القانونية الراسخة. كما أن هذه التحولات العلمية تستلزم تحديث النصوص القانونية بشكل عاجل لتحديد حقوق وواجبات الشخصيات الافتراضية، سواء على صعيد المسؤولية المدنية أو الحقوق المالية أو القانونية الأخرى، بما يضمن تكامل النظام القانوني واستيعاب التقدم التكنولوجي دون الإخلال بالمبادئ الأساسية للشخصية القانونية. وتشير الورقة إلى ضرورة وضع إطار تشريعي واضح للاعتراف بالشخصية الافتراضية، يوازن بين الابتكار التكنولوجي والحماية القانونية، ويؤسس لنظام قانوني مستقبلي قادر على مواجهة التحديات العلمية الحديثة، بما يتيح استيعاب الكيانات الذكية بشكل مسؤول وآمن ضمن منظومة القانون. These developments are no longer merely technological progress but directly challenge traditional legal foundations, raising questions about the possibility of granting these entities rights and obligations similar to those of traditional legal persons. Hence, the importance of expanding the legal recognition of legal personality to include such entities becomes evident, while implementing the necessary safeguards to protect society from any potential negative effects arising from their actions or decisions, ensuring a balance between technological advancement and established legal principles. Furthermore, these scientific transformations necessitate the urgent updating of legal texts to define the rights and duties of virtual legal entities, whether in terms of civil liability, financial rights, or other legal obligations, ensuring the coherence of the legal system and accommodating technological progress without undermining the fundamental principles of legal personality. The paper also emphasizes the need to establish a clear legislative framework for recognizing virtual legal personality, balancing technological innovation with legal protection, and laying the foundation for a future legal system capable of addressing modern scientific challenges, responsibly and safely integrating intelligent entities into the legal framework.
