Administrative Sanctions As A Deterrent Guarantee For Environmental Protection And Controls Of Their Application In The Algerian Legislation

Abstract
Administrative punishment is one of the deterrent methods taken by the administrative control authorities in order to preserve the environment, where most of the legislation, similar to the Algerian legislation, has moved towards imposing administrative sanctions on violations committed in the environmental field, by granting the control authorities relatively broad powers to impose many procedures and controls on violators, which in turn achieves a deterrent guarantee for the protection of the environment, and in turn, the legislator has imposed procedural controls for the application of these sanctions, in order to reconcile the maintenance of public order on the one hand, and the imposition of procedural controls, to ensure that the freedoms of individuals are not infringed on the other hand. يعد الجزاء الإداري من الأساليب الردعية التي تتخذها سلطات الضبط الإداري من أجل المحافظة على البيئة، حيث عمدت معظم التشريعات وعلى غرارها التشريع الجزائري إلى التوجه نحو فرض جزاءات إدارية على المخالفات المرتكبة في المجال البيئي، وذلك بتخويل السلطات الضبطية صلاحيات واسعة نسبيا في فرض العديد من الإجراءات والضوابط على المخالفين، وهو ما يحقق بدوره ضمانة ردعية لحماية البيئة، و بالمقابل فقد فرض المشرع ضوابط إجرائية لتطبيق هذه الجزاءات، من أجل التوفيق بين الحفاظ على النظام العام من جهة، وفرض ضوابط إجرائية، ضمانا لعدم المساس بحريات الأفراد من جهة أخرى.
